1. Acceptance of Terms

By creating an account and using BoozeReports, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

2. Account Usage and Restrictions

• No Account Sharing: Each account is for individual use only. You may not share your login credentials with anyone else. Sharing accounts violates these terms and may result in immediate account termination.
• No Excessive Use: You may not use automated tools, scripts, bots, or any other means to excessively query, scrape, or download data from our service beyond normal human usage patterns.
• One Account Per Person: You may only maintain one active account. Creating multiple accounts for any purpose is prohibited.
• No Reselling: You may not resell, redistribute, or sublicense access to our service or data without explicit written permission.

3. Service Description

BoozeReports provides access to publicly available Texas Alcoholic Beverage Commission (TABC) data for informational purposes. We aggregate and present this data in an accessible format with additional analytics features.

4. Subscription and Payment Terms

• Free Tier: Limited access to basic features and current month data.
• Premium Tiers:
  • Monthly — $12.00, billed every month
  • 3 Months — $34.20, billed every 3 months ($11.40/mo, save 5%)
  • 6 Months — $64.80, billed every 6 months ($10.80/mo, save 10%)
  • Annual — $99.00, billed yearly ($8.25/mo, save 31%)
• One user per account: Each subscription covers a single named user. Sharing your login credentials, password, session, share-link with anyone outside your account, or providing access to multiple individuals — including team members, colleagues, or family — is prohibited and grounds for immediate termination without refund.
• No team / company accounts on the consumer plans: If you need multi-seat access, contact us at [email protected] for an Enterprise quote. The Monthly / 3-Month / 6-Month / Annual plans are individual-use only.
• Trial: A 7-day free trial is offered to new users on first sign-up only. The trial converts to a paid subscription unless cancelled before it ends.
• Billing & Auto-renewal: All Premium plans renew automatically at the end of each billing period at the then-current rate. You may cancel any time before the next renewal in your account settings; cancellation prevents future charges but does not refund the current period.
• Sales tax: Applicable sales tax is calculated and added at checkout based on your billing address (Stripe Tax). Your invoice will show the tax line separately.
• Refunds: Subscription fees are non-refundable except where required by law. We may, at our discretion, refund a current-month charge if you cancel within 24 hours of billing and have not made significant use of Premium features.
• Price Changes: We may change subscription prices with at least 30 days' notice to existing subscribers. Any price change applies to your next renewal — never the current paid period.

5. Data Usage and Limitations

• All data is sourced from public TABC records and is provided "as is"
• We make no guarantees about data accuracy, completeness, or timeliness
• Data should not be used as the sole basis for business or legal decisions
• Users are responsible for verifying critical information independently

6. Prohibited Activities

You agree not to:

• Use the service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers
• Upload viruses, malware, or any malicious code
• Impersonate any person or entity or misrepresent your affiliation
• Harass, abuse, or harm other users
• Scrape, crawl, or use automated tools to access the service beyond API rate limits
• Reverse engineer, decompile, or disassemble any part of the service

7. Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Excessive or abusive use of the service
• Non-payment of subscription fees
• Account sharing or unauthorized access

8. Intellectual Property

The service, including all content, features, and functionality, is owned by BoozeReports and is protected by copyright, trademark, and other intellectual property laws. TABC data remains in the public domain.

9. Limitation of Liability

To the maximum extent permitted by law:

• The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for decisions made based on data from our service

10. Indemnification

You agree to indemnify and hold harmless BoozeReports from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

11. Privacy

Your use of the service is also governed by our Privacy Policy. We collect minimal personal information and do not sell your data to third parties.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

13. Dispute Resolution

Any disputes arising from these terms or use of the service shall be governed by the laws of the State of Texas. You agree to submit to the exclusive jurisdiction of courts in Texas.
